We are pleased to announce a recent victory for our client who suffered a serious injury while working at a Tyson Foods plant in Texas.
Our client began working at Tyson Foods in September 2023. His job involved a physically demanding task: hanging pig bellies on a series of elevated "trees." Each tree had three levels, with 16 bellies hanging on each level. The top level was a significant height, reaching 10-12 feet.
The core of the case revolved around an incident that occurred in December of 2023.
As he bent over to pick up a 22-pound pig belly, another belly fell on him, impacting his head and neck. The strike caused him to blackout. Despite reporting the incident to his supervisor and experiencing immediate pain, our client received minimal initial support.
Following the incident, our client was sent to the company doctor for evaluation. X-rays were taken, and the doctor attributed his pain to arthritis. While he was placed on light duty, attempting to return to work proved difficult. He experienced further pain, dizziness, and anxiety.
Seeking further medical attention, he visited the ER and was diagnosed with a concussion. An MRI revealed no significant structural damage but confirmed the concussion diagnosis. Despite the diagnosis, the company doctor maintained that his pain stemmed from pre-existing conditions.
The situation worsened when our client requested his medical records from the company doctor. This request was denied. Additionally, after being placed on light duty pushing a button, the company attempted to pressure him into signing a "return to work" waiver without providing the requested medical records.
Frustrated by the lack of support and mounting medical bills, our client sought legal representation. We took on his case to ensure he received the medical care he needed and fair compensation for his work-related injury.
