Seltex Transport settles 18-wheeler case brought by woman

On September 16, 2004, our client was traveling on South Loop West in Houston in a sedan when her car collided with a tractor-trailer attempting to change lanes from left to right. The rear passenger side of the flat-bed trailer propelled our client’s car into the concrete highway barrier to her right. Her car was totaled.An ambulance took our client to the hospital right away. Several weeks afterward, she was diagnosed with an annular tear and protrusion in her spinal discs between the fourth and fifth lumbar vertebrae. She underwent two course of treatment for her spine injury: a series of steroid injections coupled with physical therapy, and later an intradiscal electrothermal annuloplasty procedure, which cauterizes nerve endings within disc walls to block pain signals.She hired Vuk Vujasinovic to pursue a legal claim against the truck driver and his employer, Seltex Inc., operating as Transport Services, Pflugerville. Our client demanded compensation for her medical expenses and lost wages.

 

The defense argued that our client should have seen the tractor-trailer changing lanes and could have steered away from the accident. The defendants also tried to claim that the back injury was a pre-existing condition. However, they settled the case for $190,000 before trial began.
