A collision beside an 18-wheeler
Kurt’s passenger car was in the lane to the right of a truck operated by U.S.A. Logistics Carriers, LLC. After the collision, the company maintained that Kurt had moved into the truck’s lane and caused the impact.
The insurance company denied his injury claim. Kurt hired VB Attorneys, and the firm filed suit in Harris County.
The evidence extended beyond the drivers’ accounts
The trucking company retained an accident-reconstruction expert who blamed Kurt. Vuk and the VB Attorneys team obtained company documents and testimony from its representatives, an independent witness and the investigating police officer.
That evidence supported Kurt’s position that the truck driver caused the crash. The case was not limited to one driver’s account against the other’s; it included outside testimony and records obtained during litigation.
Neck surgery and a second dispute
Kurt suffered neck and back injuries. Approximately four months after the wreck, his doctors performed a two-level cervical fusion.
The company also disputed whether the crash could have injured him, relying on an orthopedic doctor and a biomechanical expert. Vuk and the VB Attorneys team obtained testimony from Kurt’s treating physicians confirming that the collision had injured him.
An $875,000 resolution at mediation
The case settled at mediation for $875,000. The result followed litigation addressing both the company’s attempt to place responsibility on Kurt and its challenge to the connection between the crash and his injuries.
