A lane change on South Loop West
On September 16, 2004, our client was driving a sedan on South Loop West in Houston when it collided with a tractor-trailer moving from the left lane toward the right.
The rear passenger side of the flatbed trailer propelled her sedan into the concrete barrier beside the roadway. An ambulance took her to the hospital.
The injury persisted after the wreck
Several weeks later, doctors diagnosed an annular tear and disc protrusion at L4-5 in her lower back.
Treatment included physical therapy and steroid injections. She later underwent intradiscal electrothermal annuloplasty, a procedure using heat within a spinal disc to address pain.
The trucking company disputed both fault and injury
Vuk pursued claims against the truck driver and his employer, Seltex Inc., operating as Transport Services. The claim sought compensation for the client’s medical expenses and lost wages.
The defense argued that she should have seen the trailer moving into her lane and steered away. It also contended that her back condition existed before the collision.
The case therefore involved two distinct disputes: responsibility for the lane-change collision and whether the crash caused the spinal injury for which she received treatment.
A settlement before trial
The parties resolved the case for $190,000 before trial began. The settlement concluded the disputed claim arising from the flatbed-trailer collision and the driver’s resulting treatment.
