A landscaping crew traveling together
On June 1, 2004, Juan and three other men were traveling south on Highway 249 in northwest Houston. All four were working for a landscaping company at the time.
Juan was riding in the pickup bed. The pickup was towing a utility trailer owned by the landscaping company.
The vehicle skidded onto the shoulder, struck a metal barrier, turned onto its passenger side and caught fire. Juan was ejected from the pickup and fell from the overpass. He died at the scene.
A claim against the driver and the company
Vuk and the VB Attorneys team represented Juan’s family in a claim against the pickup driver and the landscaping company.
The lawsuit arose from transportation involving a company’s work crew and equipment. The family sought accountability for the fatal crash and compensation for the loss of Juan.
The case was pursued in Harris County and approached a scheduled trial before the parties reached an agreement.
Resolving the case before trial
The day before trial, the defendants agreed to settle the family’s claims for $700,000.
The settlement included contributions from two insurers: $675,000 from Ohio Casualty and the $25,000 policy limit from Allstate. Those contributions together made up the total settlement.
A resolution for Juan’s family
The settlement resolved the family’s claims arising from the fatal pickup crash. It followed a lawsuit against both the driver and the landscaping company whose crew was traveling together.
For Juan’s family, the case concerned the loss of a husband and father during a work-related journey. Vuk and the VB Attorneys team pursued that claim through the eve of trial.
