A company truck interrupted a young woman’s life

Audrey B. was attending college when a company-owned Ford F-250 towing a loaded trailer struck her vehicle from behind at highway speed. The driver worked for Sportscapers, a construction company. The investigating police officer cited him for failing to control his speed.

The company truck and trailer, even without their load, weighed more than three times as much as Audrey’s vehicle. The collision injured three levels of her neck: C3-C4, C4-C5 and C5-C6.

Before the crash, Audrey enjoyed golf, hiking, cycling and spending time outdoors with her husband. Her injuries disrupted those activities and her education. Medical appointments, surgery and recovery also forced her to postpone plans to start a family.

Treatment led to a three-level neck fusion

Audrey first pursued physical therapy, trigger-point injections and pain-management treatment. Those measures did not eliminate the need for surgery.

A board-certified neurosurgeon eventually performed a three-level anterior cervical decompression and fusion from C3 to C6. Audrey continued to experience pain and faced the prospect of additional surgery. Her claim therefore involved the consequences of the neck injury beyond the initial treatment and recovery.

Questions about the company’s safety practices

Vuk deposed Sportscapers’ corporate representative and investigated the company’s handling of the driver and the crash.

The investigation identified failures in driver screening, supervision and safe-driving training. It also examined what the company did after the collision. Supervisors had not investigated the crash, prepared an accident report, examined the driver’s phone records or screened him for drugs or alcohol.

A settlement for the available insurance limits

Vuk and the legal team resolved Audrey’s case for $953,000, the maximum available insurance policy limits.

The settlement addressed the costs and consequences of Audrey’s injury, including past treatment and future medical needs.
