A serious collision on the way to work

Floyd was on his way to work when the collision occurred on August 28, 2018. His case alleged that a truck ran a red light and struck his vehicle.

The firm’s initial report described rescue crews using hydraulic extraction equipment to free Floyd from his car. The collision left him facing treatment and time away from work.

Shoulder surgery and a back injury

Floyd’s written discovery answers identified injuries to his shoulder and back. His shoulder required surgery. His doctor also prescribed a steroid injection for his back.

Those treatment needs formed part of his injury claim. The case addressed the physical consequences of the crash as well as the dispute over responsibility for the truck.

The insurer said the truck had been stolen

The trucking company’s insurer claimed that the truck had been stolen when the wreck happened. That position raised a question about whether the driver was authorized to use the truck.

Brian represented Floyd in the lawsuit against J.A.M. Distributing and driver Ron Christopher Campbell. The case examined the driver’s authority to operate the truck and the company’s responsibility for what happened.

An insurance-policy-limits settlement

The parties attended mediation and reached an insurance-policy-limits settlement resolving Floyd’s injury claim. The resolution followed litigation over the collision, Floyd’s treatment needs and the disputed circumstances of the driver’s use of the truck.
