A collision on the feeder road

At trial, Gene described being thrown from his motorcycle across the pavement of a feeder road. His injuries led to hospitalization, surgical treatment and a continuing recovery.

The lawsuit named LJT Transportation, LLC and truck driver Antonio Morales. It addressed both the collision and the decisions the trucking company made about its driver.

Brian sought the calls and driving records

Brian asked the court to admit three 911 calls, including a caller’s immediate description of an 18-wheeler hitting a motorcycle. The calls came from City of Katy Police Department records.

He also asked to introduce Morales’s driving record because the lawsuit challenged LJT’s hiring and supervision of him. These requests sought to put the driver’s safety history and the immediate accounts of the collision before the jury.

Comparing Gene’s condition before and after

Gene had undergone back surgery before the collision. His case addressed whether the truck crash aggravated that condition, rather than treating his earlier back problems as the whole explanation for his injuries.

Gene’s treating physician testified about crash-related injuries and surgery provided after the crash. The medical evidence also included Dr. Anjali Jain’s testimony and her life-care plan addressing future pain-management needs.

The jury’s damages assessment and fault allocation

The jury assessed $219,500 in damages: $30,000 for past physical pain and mental anguish, $7,500 for past physical impairment, $140,000 for past medical care and $42,000 for future medical care.

The jury assigned 60% of the responsibility to Morales, 25% to LJT and 15% to Gene. Applying Gene’s share reduced the damages calculation to $186,575 before interest and court costs.

The $219,500 verdict is the jury’s damages assessment before that reduction.
