A truck moved into Gerardo’s lane
Gerardo was driving east in the left lane of East Barbours Cut Boulevard in La Porte when a second tractor-trailer moved in front of him from the right lane. The collision injured his neck and back. An ambulance took him to San Jacinto Methodist Hospital.
The La Porte Police Department investigated and placed responsibility on the Canal Cartage truck driver for an unsafe lane change. The defense disputed responsibility, and the case proceeded to trial in Harris County.
The jury heard directly from the investigating officer
The defense challenged the investigating officer’s qualifications and conclusions. Brian presented the police report and the officer’s live testimony about his investigation.
His testimony explained the basis for the finding that the Canal Cartage driver had caused the collision. The jury ultimately assigned that driver 100 percent of the responsibility.
Medical testimony addressed the injury dispute
The defense disputed whether the crash had injured Gerardo, the seriousness of his condition and the need for his medical treatment. Brian cross-examined the defense neurosurgeon and challenged his opinions.
Brian also presented testimony from Gerardo’s treating orthopedic surgeon. His medical and billing records gave the jury evidence of the treatment and charges underlying his damages claim.
Gerardo did not seek past or future lost wages. His damages claim concerned medical expenses and pain and suffering.
A $286,000 jury verdict
The jury found the Canal Cartage truck driver negligent and awarded Gerardo $286,000. The verdict resolved the trial disputes over responsibility for the collision and Gerardo’s damages.
