A crew-change task ended in the river
The tankerman was preparing for a crew change and refilling potable water on a tugboat on the far side of a barge. As he climbed down from the barge toward the pier, the ladder shifted. He struck the deck before falling into the water.
Rescuers pulled him from the river. The fall damaged three tendons in his shoulder, shattered his elbow and caused a head injury associated with vertigo and tinnitus.
The company disputed responsibility
The employer contended that the tankerman bore a substantial share of responsibility. Brian represented him through litigation that included nearly 30 depositions in several states, two mediations and extensive trial preparation.
The dispute required examining the ladder, the work he was performing and the circumstances of his fall.
A negotiated resolution
The parties reached a confidential settlement after three years of litigation. The amount is not disclosed.
