An overturned truck left pipe across the interstate
Tom was driving his Lexus north on Interstate 45 in the early morning when he saw a large object across the roadway. Thick fog limited visibility. He swerved to avoid the object but struck it.
The object was a piece of drill pipe. Shortly before Tom reached it, a Texas International Express, LLC 18-wheeler had overturned and scattered its load across the interstate. The collision injured Tom’s lower back. His doctors performed fusion surgery to address his symptoms.
Driver fatigue and inadequate supervision
Vuk pursued Tom’s claim in Harris County. The trucking company and its driver denied responsibility for the crash.
Vuk used evidence that the driver had worked too many hours and fell asleep at the wheel to address the defense’s denial of responsibility. The truck left the roadway. When the driver woke, he overcorrected and rolled the rig onto its side, spilling its load.
Vuk also established that Texas International Express had not properly qualified or supervised its driver. Those failures connected the company’s conduct to the rollover that left drill pipe in Tom’s path.
A settlement before trial
The parties resolved Tom’s case for $437,500 before the trial date.
