A falling load struck his head
The processor began working at Tyson Foods in September 2023. His work involved hanging pig bellies on elevated racks known as trees. Each tree had three levels, with 16 bellies on each level. The highest level stood 10 to 12 feet above the ground.
In December 2023, he bent to pick up a 22-pound pig belly. Another belly fell onto his head and neck, and he blacked out. He reported the incident to his supervisor and experienced immediate pain.
Two different medical assessments
The company doctor took x-rays and attributed the processor’s pain to arthritis. The doctor placed him on light duty, but the processor continued to experience pain, dizziness, and anxiety when he tried to work.
He sought further care at an emergency room, where doctors diagnosed a concussion. The company doctor continued to attribute his pain to preexisting conditions.
A records request and a waiver
The processor could not obtain the medical records he requested from the company doctor. His light-duty assignment involved pushing a button.
The company sought his signature on a return-to-work waiver without providing the records he had requested. With medical bills mounting, he turned to Vuk and Job for help.
Medical care and compensation
Vuk and Job pursued his workplace-injury case and obtained a confidential settlement that provided medical care and compensation for his injury and lost wages.
