A fatal fire and silent smoke alarms
The apartment fire took a mother’s life and left her family facing an irreversible loss. The family’s case focused on whether the apartment’s smoke alarms had been properly installed and maintained.
Preserving evidence and examining the alarm system
Brian worked closely with co-counsel on the family’s case and litigation strategy. The case included a request for a temporary restraining order to protect evidence from alteration or destruction.
Experts examined the alarm system. They concluded that the alarms had not been properly wired, inspected or maintained. In their assessment, the alarms should have been interconnected so that activation of one would trigger the others. None of the seven alarms sounded on the night of the fire.
The family’s case reached a confidential settlement
Brian and co-counsel prepared the case for trial. The property owner ultimately agreed to a confidential settlement resolving the family’s claims.
