A fall from the front car
Sam was a teenager visiting Astroworld in Houston with a group of friends. He was riding in the front car of the indoor Mayan Mindbender roller coaster.
As the cars descended into near darkness and turned to the right, Sam was thrown from the car. He fell approximately 20 feet to the concrete floor below.
Serious injuries with lasting consequences
The fall caused fractures to Sam’s face, left hip and left ankle. Some of the injuries left permanent effects.
A neuropsychologist diagnosed cognitive deficits and post-traumatic stress disorder associated with the accident. Sam also experienced facial disfigurement and difficulty breathing through his nose.
The family’s claim concerned more than the initial fractures. It also addressed the lasting physical and psychological consequences of the fall.
Challenging the restraint systems
Vuk and the VB Attorneys team pursued claims against the theme-park company and the ride supervisor on behalf of Sam and his parents.
The lawsuit alleged that the ride’s restraint systems were defective. The defense disputed responsibility and asserted, among other things, that Sam had been standing up.
The case therefore involved competing accounts of how Sam left the car and whether the restraints adequately protected him. The court dismissed a deceptive-trade-practices claim, while the injury case continued.
A confidential settlement
The parties reached a confidential settlement during a second round of mediation.
The agreement resolved a case involving a serious amusement-ride injury and lasting consequences for a young passenger. The settlement amount remains confidential.
