A filter cap came off its housing
Robert was working at a refinery when a filter cap detached from its housing and struck him in the legs. Another worker was also injured.
The equipment was a C3/C4 filter in the refinery’s light-oils unit. The resulting lawsuit concerned not just the moment of failure, but the inspections that preceded it.
The inspection responsibilities became central
The litigation involved contractors with different roles in inspecting refinery equipment before and during a turnaround. The disputed questions included whether the filter cap should have been repaired, replaced or taken out of service.
The defendants contested responsibility. In its court filing, one contractor pointed to the work of other inspection companies and also alleged that the injured workers shared responsibility. Those were disputed positions in the lawsuit, not findings against Robert.
Brian and the VB Attorneys team pursued Robert’s third-party injury claims through that disagreement over who was responsible for the equipment and its condition.
The court rejected a bid to end the claims
One defendant asked the court to dispose of the claims against it through summary judgment, including a no-evidence motion.
The Harris County court denied both motions in all respects. That ruling kept the claims against that defendant in the case. It was a procedural result that allowed the litigation to continue, not a finding that the defendant was liable.
For Robert, it meant the defendant had not succeeded in ending those claims before trial. The case continued toward resolution.
A confidential settlement
Robert’s third-party injury case resolved through a confidential settlement. The financial terms are not disclosed.
The case brought the work of multiple refinery contractors into focus after equipment failed and caused serious injury. Brian and VB Attorneys pursued Robert’s claims through contested responsibility and the effort to end part of the case before trial.
