A failed hose at a Galena Park plant
Mia worked for Shamrock Farrell, which HMT had hired to help with a job at the plant. During a procedure HMT was running, an HMT-owned hose failed. The high-pressure water struck Mia, causing her to twist and fall. She injured her lower back.
The company blamed the hose manufacturer
After HMT did not respond to Mia's claim, Vuk pursued a third-party lawsuit in Harris County. HMT argued that the manufacturer—not HMT—was responsible for the hose failure. That dispute made the evidence about the equipment and the work procedure important.
The case involved a safety engineer and deposition testimony addressing HMT's responsibility. Vuk negotiated a confidential settlement paid by HMT's insurer.
Why identifying responsibility matters after an equipment failure
An injured worker may know what struck her without knowing why the equipment failed. A useful investigation separates those questions: Who owned and controlled the equipment? Who directed its use? What does the physical evidence show? Testimony and engineering analysis can help test competing explanations rather than simply accepting a company's account.
Mia's case illustrates that distinction. HMT pointed to the manufacturer; her claim required examining HMT's own role in the operation. The case resolved through a confidential settlement.
