A fall between vessels
Joshua was working as a crewmember when he fell from a tug into a smaller transport boat. His lawsuit alleged that a newly assigned crane operator had not been properly trained and caused the incident.
Brian and the VB Attorneys team brought claims under the Jones Act and general maritime law, challenging the training, supervision, and safety of the work. The lawsuit also sought maintenance and cure.
Two versions of the incident report
During the case, the company produced an incident report. Later, it produced another version containing additional pages and information. Joshua’s lawyers questioned a company representative twice, including about that later report.
The company disputed Joshua’s account of the cause and relied on an earlier statement attributing the incident to wind. The court denied Joshua’s request for an evidence-spoliation ruling. The injury claims continued.
A settlement for Joshua’s estate
Joshua died while the litigation was pending, and his estate continued the injury case. Brian and the VB Attorneys team pursued a resolution of those existing maritime claims.
The case resolved for $250,000. The settlement compensated the estate for the disputed injury claims and brought the litigation to an end.
