A rear-end collision interrupted his construction work
Traffic had stopped on I-45 when a Ford pickup struck Gildardo’s truck from behind. His head hit the windshield, and the damaged frame prevented the doors from opening until first responders helped.
He injured his head, neck and right arm and missed five months of work. He returned to his construction job in January 2015.
A second incident brought different injuries
Gildardo was installing siding from an elevated lift when a worker employed by another company drove a forklift into it. The impact threw him inside the bucket and injured his knee, hand and back.
The second incident again interrupted his ability to work. Pain also curtailed the running and soccer that had been part of his life. The two claims required distinguishing the injuries from the road crash from those associated with the later work incident.
Separate settlements, not one combined recovery
Vuk represented Gildardo in the two claims. The work-injury case settled in October 2016; the vehicle-collision case settled in February 2019. Both settlement amounts remain confidential. Gildardo returned to work.
The two resolutions addressed different events. Our personal injury practice includes claims in which medical evidence must distinguish a new injury from an earlier condition.
