A fatal truck collision and a family’s claims
Ian was driving a car with two passengers when a truck struck it from behind. He died from his injuries. Both passengers were injured, creating claims for Ian’s death and for the surviving passengers’ injuries.
For the family, the consequences extended beyond the collision itself. The wrongful death case sought compensation for the loss of Ian, alongside claims for injuries sustained by the passengers. The case also involved estate proceedings, adding a separate set of courtroom issues to the work of investigating the crash.
Brian pursued the collision claims while addressing procedural disputes that threatened to interrupt the representation.
The evidence: crash video and a Facebook post about fatigue
The case evidence included video of the collision, giving Brian a record of the rear-end impact as he pursued the claims.
The investigation also uncovered a Facebook post in which the truck driver complained about his workload and how little he had slept before the collision. The driver’s own words gave Brian specific evidence to examine when investigating fatigue.

A challenge to our representation put the case at risk
As the case moved toward resolution, the defense sought to disqualify VB Attorneys over an alleged conflict. The firm disputed the challenge.
Brian Beckcom took on the resulting courtroom and briefing work. The representation dispute required substantial legal research, preparation, and court appearances alongside the work on the collision claims.
Probate proceedings and a return to Dallas district court
Related estate proceedings brought the case into probate court. Questions about estate administration and the court in which the case would proceed created additional obstacles. The litigation moved through proceedings in Dallas and Denton before Brian secured its return to Dallas district court.
Returning to district court did not immediately resolve the defense’s effort to remove the firm. Brian continued researching and briefing the representation issue. The defense ultimately withdrew its disqualification motion.
Continued negotiations led to a $3.35 million settlement
The claims arising from the fatal collision and the passengers’ injuries ultimately resolved for a total settlement of $3,350,000.
