Fifth Circuit Opinion Reverses Federal Judge's Decision

Posted on Aug 11, 2016

Captain Wren ThomasOn August 11, 2016 the Fifth Circuit Court of Appeals reversed the opinion of a federal judge in our Nigerian piracy lawsuit.

The federal trial court had denied our request for leave to amend our petition on the grounds the amendment would be futile. The Fifth Circuit reversed their ruling, saying the "district court erred in denying his motion."

This lawsuit has been filed against Edison Chouest Offshore and Chevron USA, on behalf of Captain Wren Thomas. Mr. Thomas was kidnapped by Nigerian pirates in the Gulf of Guinea in October 2013, held captive for 18 days, tortured, and starved. This appellate decision allows our case to move forward in district court.
