Sometimes we are approached by someone who was a passenger in a car that had an accident.  They think the wreck was probably the fault of the driver of the car they were in.  They are not sure whether they can sue the driver of the car they were in that wreck?

Answer:  Yes, as a passenger you can sue the driver of the car you were in that had an accident.  If the driver of the car you were in was at fault, there is no rule saying you cannot sue that driver.

Many times a passenger will know the driver:  the driver may be a friend, or even a family member.  In such situations, sometimes the passenger is reluctant to sue.

Keep this in mind:  there is almost always auto insurance involved, and just because you have to bring a lawsuit against the driver does not mean you are taking any of their personal money.  Instead, the insurance company will be paying your claim.
