We know the commercials, even the name “Orkin Man” might trigger a jingle of a deep voice all too familiar if you watch television. Orkin is a nationwide company that people call upon to get rid of unsightly pests such as ants, mosquitoes or cockroaches.
One Denton, TX man doesn’t hear the jingle replay in his head when he hears “Orkin Man” -- he has nightmares.
A 41-year old Installation Technician who was working for a company that works in conjunction with DirecTV, was on the job at a customer's home when the Orkin man came calling to spray around the house for pests. The Orkin man failed to follow several safety rules and sprayed the technician with the pesticide.
Pesticide poisoning is very serious, and someone who has been exposed to even small amounts of it requires immediate medical attention. In this case, the victim continues to suffer from pain in his lungs, difficulty breathing, general fatigue, and many neurological problems. He will have a long road to recovery ahead of him with a team of medical professionals behind him including a toxicologist and a neurologist.
The Installation Technician has hired the Houston based law firm VB Attorneys to represent him in a multi-million dollar lawsuit against Orkin. Attorney Vuk Vujasinovic, co-founder of the firm, will be the lead counsel.
“How someone can be so careless when dealing with harmful materials is incomprehensible”, said Vujasinovic. “Anyone who works in an industry with chemicals that are poisonous to humans has a duty to take their job seriously and know what they are doing. Companies like Orkin have a duty to ensure their employees are trained properly and are following company procedures when on a job like this.”
The company the technician was working for has workers compensation insurance. This suit is not directed to the technician's employer, but to Orkin, and is considered a third party case.
