A Valentine’s Day wreck on a California road opened up a big legal question about driverless technology. The car that caused the crash was one of Google’s self-driving cars, and it was the first time that a self-driving car has been involved in a collision that wasn’t the other driver’s fault. Google Car Collides With Bus While in Autonomous Mode
A self-driving Lexus RX450h, owned by Google, was in autonomous mode in Mountain View, California. As it attempted to navigate around sandbags in the road, it collided with a public bus. Google’s car was going about 2 mph at the time, while the bus was going about 15 mph. Although the bus had 15 passengers and a driver onboard at the time, no injuries were reported. Both vehicles sustained minor damages. Although the self-driving car did have a manual driver at the time, the driver did not override the self-driving mode because it was assumed—by both the human driver and the car’s programming—that the bus would yield.
Google has accepted that they have some responsibility in the accident, and says the company has now refined their self-driving software to account for larger vehicles that may be less likely to yield.
The Difference Between Self-Driving Cars and Human Drivers
Currently, Google’s self-driving cars react to most confusing or difficult situations on the road by stopping. However, as self-driving cars become more complex and refined, they’ll have to find ways to make the kinds of decisions that human drivers can make. For example, while human drivers can decide to swerve and hit another car in order to avoid a child running into the street, how will a self-driving car be programmed to react? How will a self-driving car place value on “obstacles” when a crash is unavoidable? What if it means injuring car passengers to avoid hitting a child? Of course, there are also a lot of questions about how varying state laws will apply to self-driving cars in the future. Currently, establishing fault for an accident can be very different depending on where the accident happens. “No fault” laws and other differences by state could make proving an injury case involving a self-driving car all the more difficult, and some experts predict that could lead to more federal regulation.
