What happens if the police don't come to the scene of your accident?
You've just been hit by someone, you have the other driver's insurance information, and the accident was the other driver's fault. What are your options?
Can you still file a legal claim against the other driver if the police didn't come to the scene of the accident or give the other driver a ticket or a citation?
Although it is always recommended to contact the police if you have been involved in a wreck, you can still file a claim for your damages even if the police did not come to the scene.
It is a good idea to carry a disposable camera in your car or use your smartphone to take pictures of the damaged vehicles as well as the scene of the accident. That way, you have documentation of what happened, what the accident looked like.
Also, when exchanging information with the other driver, make sure you have his or her license information as well as the insurance information. This will be helpful when you file your claim.
