What is the "Floor Mat Entrapment" hazard?
This happens when the floor mat interferes with the accelerator pedal and causes it to get stuck in the wide-open position. This can cause the Toyota vehicle to experience "unintended acceleration." This situation is very dangerous and can lead to very serious accidents.

What is the "Pedal" hazard?
This is also referred to as the "Sticking Accelerator Pedal" or "Sticky Gas Pedal" hazard. Mechanisms in the Toyota accelerator pedal stick in a partially depressed position or return slowly to the idle position. Again, this is known to cause "unintended acceleration" which can cause car crashes.

What is the status of lawsuits against Toyota based on these recalls?
Several Toyota Recall lawsuits have been filed against Toyota across the country. These lawsuits involve cases where one or both of these recalls cause serious car accidents, many resulting in deaths and catastrophic injuries.
Our Houston, Texas-based Board Certified Toyota Recall Lawyers are handling and investigating numerous Toyota Recall Lawsuits involving both the Floor Mat Entrapment Recall and Sticky Gas Pedal Recall. If you have any questions, please contact us.
What is Toyota's liability in these Vehicle Recall Lawsuits?
As the manufacturer of these vehicles, Toyota has a responsibility to safely manufacture, design and market them. If there is a defect in a vehicle that causes a crash, generally the car manufacturer -- in these instances, Toyota -- will be liable for any damages caused in the crash.
Cases involving recalled products are generally stronger than cases in which the products have not been recalled. Because Toyota is recalling these vehicles, the cases against them will be relatively strong -- because a recall is like an admission that something is wrong with their vehicle.
Toyota will likely defend these lawsuits by admitting their vehicle was defective, but arguing that the defect did not cause the crash or the injuries. Toyota and its lawyers are likely to argue that the driver of the vehicle either caused the crash, or that the driver should have been able to handle the situation brought about by the defective car and not allowed an accident. An experienced and board certified attorney should be able to diffuse such defenses.
What kind of damages or compensation is available in a Toyota Car Recall Lawsuit?
Generally, the following types of damages should be available:
- Past & Future Medical Bills
- Past & Future Lost Wages
- Past & Future Physical Impairment
- Past & Future Disfigurement
- Past & Future Pain / Mental Anguish
- If a fatality case: Past & Future Damages for the loss of a loved one
