Nobody wants to be the victim of an injury or accident that was caused by someone else's carelessness. However, all too often, innocent parties are injured, or even killed, because of the recklessness or carelessness of another person or company.

In any injury or accident case in Texas, the injured person must prove negligence on carelessness of another caused injury. Even if it seems clear that someone caused injury by being negligent or reckless, the insurance companies will often fight tooth and nail, dispute every little bill, and try to make it seem like the innocent party is at fault. They will delay, deny, and distort until the bitter end.

The fact is, most insurance companies don't treat injured people fairly

Insurance companies make money by collecting premiums and investing those premiums in the stock market. They do not make money paying out claims. Some of the insurance companies will write letters telling innocent injured people not to seek representation. The insurance companies have paid millions and millions of dollars to create propaganda discouraging people from hiring lawyers or bringing claims, even when those claims are completely legitimate and the person is badly injured.

Because of these simple facts, insurance companies fight claims, including legitimate ones, tooth and nail. They make you sign releases, give recorded statements, and try to make it seem like it was your fault.

How do you fight back? By showing them that you are ready, willing, and able to fight back.

Unfortunately, negotiating with insurance companies before filing suit is almost always unsuccessful

Insurance companies know every trick in the book. They will try to convince you to settle before hiring a lawyer. They will tell you that they will treat you fairly. They will send you to pre-selected doctors. But all too often, what they are really doing is trying to figure out a way to avoid paying anything, or to avoid paying a full and fair settlement.

Our approach is straightforward. After investigating your case, if we believe that it is legitimate and has merit, we file a lawsuit immediately and begin the process of proving who was at fault, and what the full damages are. That way, if negotiations don't work, we have a trial date and are ready to go to Court.

Once we file a lawsuit, both sides begin what is called "discovery." That is the formal legal name for the process whereby both sides investigate the facts of the case. The defendant will be able to check into your background and history and test whether your claims are valid. We do the same to the defendant and see if their excuses are real or fake, or made up, or lack merit.

Once the case has been fully investigated, if it cannot be settled fairly, we will hopefully have a trial date and will be ready to let a jury decide the case.
