A statute in Texas called the Texas Wrongful Death Act sets out the rules for fatality cases. Most states have a death statute with similar rules. Only certain classes of family members are entitled to bring a claim for "wrongful death." The law also allows a claim on behalf of the deceased person, called a "survival" claim.
