Texas Mother Sues After Son Killed And Daughter Burned In Daycare Accident

Posted on Apr 20, 2011

Following a tragic and shocking daycare fire in Katy, Texas, that killed four children and left others severely burned, a mother has filed a personal injury lawsuit and wrongful death lawsuit against the owner of the in-home childcare facility.

The fatal daycare fire took place last month at the home of 22-year-old Jessica Tata, who had just recently registered as a childcare provider in Texas despite her apparent lack of training or skills. On February 24, the woman allegedly left seven children at her home without supervision while she went shopping at a local store. When she returned home, she found her home in flames – with four children dead and three suffering serious burns and smoke inhalation.

Now, Texas mother Tiffany Dickerson has filed a lawsuit both against Tata and against Tata’s parents, who allegedly helped the daycare provider briefly flee to Nigeria in the days after the incident. Dickerson is suing on behalf of her 3-year-old son who died in the fire as well as her 2-year-old daughter, who suffered burn injuries. She is seeking actual damages, punitive damages, attorney’s fees, and court costs. Other similar wrongful death and personal injury lawsuits are expected to follow from other parents.

Tata has been charged with four counts of murder, four counts of manslaughter, six counts of reckless injury to a child and three counts of abandoning a child under the age of 15.
