A Port Arthur auto accident victim has filed a lawsuit in Jefferson County District Court over a car wreck. The victim, Chandra Jones, claims that she suffered a fractured pelvis in an auto accident in 2009.
According to the suit, Ms. Jones was a passenger in a vehicle being driven by Leon Thomas. Thomas, alleges the suit, failed to yield the right-of-way at a stop sign, which caused him to drive into a UPS truck in the intersection.
Thomas is accused of negligently failing to maintain proper control of his vehicle, failing to give appropriate attention to the operation of the vehicle, failure to use reasonable care, failiure to maintain a proper lookout and failure to yield the right of way.
The UPS driver is also named in the suit, and is accused of failing to maintain control of the UPS truck, failure to give the appropriate attention to the operation of the truck, driving too fast for conditions and failing to maintain adequate lookout.
These failures, claim the lawsuit, all led Jones to suffer from physical and mental anguish, pain and suffering and of course medical costs for her fractured pelvis. She also believes she is owed lost wages and lost earnings due to her inability to work after the wreck.
It is not unusual to see a car accident victim sue the driver of the car they were driving in, especially if the victim's injuries were serious and the driver was negligent.
