Marshall tractor-trailer wreck leads to injury lawsuit

A vehicle accident in Marshall, Texas has led to a lawsuit against a trucking company. The case was filed in the Eastern District of Texas this month by Knox Wesley Mosby Jr., and his wife.

According to Mr. Mosby, he was driving a John Deere tractor while towing a John Deere bailer on U.S. 79 when he was thrown from the tractor and injured in an accident. The suit was filed against driver Ronald Jason Bowman and his employer, Averitt Express Inc.

Mosby claims that at the time of the accident his tractor was being escorted by his Ford F-350, which was being driven by Steven Smith. Both the tractor and the Ford truck had their hazard lights flashing, as they were driving at a slow rate of speed.

The suit alleges that Bowman came up on the Ford truck, which was behind the tractor, at a high rate of speed. He was not able to stop in time and crashed into the Ford, which in turn struck the tractor, dislodging Mr. Mosby.

As a result of his injuries, Mosby is seeking damages for medical expenses, comensation for pain and suffering, mental anguish, physical disability and impairment, lost wages and loss of the ability to earn wages, disfigurement, loss of business income and consortium, and more.

Defendant Bowman has a strike against him, in that he was cited by police for failure to control his speed. This will likely count against him in the case.
