A Huntsville father has requested a jury trial for the wrongful death lawsuit he has filed against his deceased son’s former employer. Galveston County 122nd District Court Judge John Ellisor will hear the worker death case.
In August 2008, Robert Hicks Junior was killed in an on-the-job accident in Galveston, Texas. The young man was working for Halcumb Air Conditioning & Refrigerating Inc. and tending to a job at a private home when he was electrocuted.
Now, the man’s father, Robert Hicks Senior, is suing Halcumb Air Conditioning & Refrigerating for wrongful death and seeking damages for pain and suffering, mental anguish, loss of companionship, medical expenses, and funeral expenses.
According to the man’s lawsuit, the air conditioning and heating company did not maintain workers’ compensation insurance for its employees as is required by Texas law. In addition, the man’s wrongful death attorney stated that the company’s negligence contributed to the employee’s death. Hicks did not have a spouse or children and did not have significant property at the time of his death.
Electrocution accidents are all too common for Texas workers in these industries. It is extremely important for companies to properly train their workers, provide them with the proper safety equipment, and take the proper actions when an accident does occur.
