Two people have filed a lawsuit in Galveston County after a defective tire allegedly caused a rollover accident that injured their two children.
The accident happened in October along Interstate 10 when driver Kevin Flores (one of the defendants) lost control of the Toyota pickup truck he was driving when, according to the lawsuit, the left rear tire tread separated. Plaintiffs Irma Espinal, Nora Flores, and their children Marco Ponce Espinal and Mirna Castellanos were passengers in the pickup truck when the accident happened. They claim that the tire separation caused the Toyota to hit another car then roll over. As a result of the accident, minor child Marco Espinal, was left in a paraplegic state.
The lawsuit is against motorist Kevin Flores, Cooper Tire & Rubber Company, and Dindial Singh (doing business as R T Tire Service). The suit was filed by Irma Espinal and Nora Flores on behalf of their two respective minor children.
According to the lawsuit, the tire that caused the accident was defective because it did separated under normal use and not have the correct wedge design and a zero degree nylon cap ply. A manufacturing defect also contributed to the accident, claims the suit – the tire had inadequate skim stock, so the tire’s components were not adhered together properly.
The Galveston County lawsuit requests a jury trial and unspecified monetary damages.
