Wrongful death cases involve two different types of potential claims: "wrongful death" claims and "survival" claims. A wrongful death claim belongs to any surviving spouse, children and parents of the decedent. A survival claim is a claim on behalf of the estate of the decedent, based on the person's conscious pain and suffering (and potentially other claims) before their death.
