Am I required to hire a union lawyer or "Union Designated" lawyer for my railroad injury case?

If you are a member of a a railroad union like the United Transportation Union, the Brotherhood of Maintenance of Way, or any other railroad union, and you are injured on the job, your rights to legal recovery will be governed by the Federal Employers' Liability Act (also known as "FELA").

In many situations, if you have been injured on the job, you will be contacted by a "union lawyer" or "union designated" lawyer. Some railroad workers believe they are required to hire a "union lawyer" for their case.

You are not required to hire a union lawyer for your railroad injury case.

Should you hire a Union-Designated Law Firm or Lawyer for your railroad injury case?

That really depends. You need to strongly consider and analyze whether you want a union lawyer for your case or whether you want a lawyer who is completely independent of the railroad or the lawyer.

Many union designated lawyers are fine lawyers. However, you need to think about how lawyers become "Union Designated" in the first place. You need to consider how muchy money the law firms who are "union designated" make from their "union designation" and how many injured FELA workers get personalized attention from these lawyers.

You have to ask yourself whether you are comfortable with a lawyer who may be somewhat familiar and close with the railroads and their insurance and claims agents.
