Houston Personal Injury Lawyer explains how to hire the best lawyer for your personal injury case by asking these SEVEN CRITICAL QUESTIONS.

BEFORE YOU HIRE AN ATTORNEY FOR YOUR PERSONAL INJURY CASE, ASK THE LAWYER THE FOLLOWING SEVEN CRITICAL QUESTIONS:

1. How long have you been practicing law? You want to know how long the attorney has actually been working as an attorney. While there is no hard and fast rule as to how many years an attorney needs to be in practice before they are qualified to handle a certain type of case, you are certainly entitled to know how long the lawyer has been practicing law. For example, if you discover that the attorney is fresh out of law school, you will probably want to consider talking to a lawyer with more experience. Also, if your case involves complicated issues, you will want to consider hiring an attorney with at least several years of experience.

2. Are you Board Certified in Personal Injury Law? Lawyers in Texas can apply to become "Board Certified" in various areas of law, including Personal Injury Trial Law. To become Board Certified, lawyers must apply with the State Bar of Texas. The State Bar sets many requirements that must be met before an attorney can apply to become Board Certified. For example, the attorney must have tried a minimum number of cases to a verdict, settled a minimum number of cases, and handled a minimum number of depositions, hearings, and other legal matters. The attorney must also present references from other lawyers, and from judges. Once those requirements are met, the lawyer must take and pass an extensive, full day examination. If the lawyer passes the examination, he or she becomes Board Certified. Less than 2% of all lawyers in Texas are Board Certified in Personal Injury Trial Law. The section of the State Bar that certifies lawyers is called the Texas Board of Legal Specialization ("TBLS"). More information on Board Certification can be found at the TBLS website. To find out whether an attorney is Board Certified, go to the TBLS Online Attorney Directory, and simply type in their name. The website will tell you whether the attorney is Board Certified, the area in which they are certified, and the year they became certified. You are not required to hire an attorney who is Board Certified, but it certainly is wise to at least speak to a certified attorney before you make your decision on who to hire.

3. Will you actually handle my case? This may sound like a silly question, but it is a very important question that you must ask. Many attorneys will get hired by a client, and then refer the case to some other attorney who will actually handle the case. If this is going to occur with your case, you are entitled to know about it. If you find out that this is the planned arrangement, you should ask to interview the lawyer to whom the case would be referred. It is your case, and you are entitled to decide who will be handling it for you. If you don't get straight answers to these questions, you should probably look elsewhere.

4. Can I see a list of your case results? Results matter in any profession, including the law. You want to find out how the lawyer has performed on client's cases in the past. On cases that he or she settled, ask what the cases were about and how much they were settled for. Some settlements are confidential, but many settlements are not and therefore you should be provided this information. Also ask the lawyer about their results in going to trial. This questions serves two purposes. First, you want to ensure that your attorney has actually taken cases to trial in the past. Second, you want to ensure that your lawyer has done a good job when he or she has gone to trial in prior cases. If you don't get clear information on the lawyer's track record, you should consider talking to a lawyer who will give you this important information.

5. Have you handled cases similar to my case? You want to hire a lawyer who is familiar with your kind of case. A lawyer who has handled your same type of case in the past will be more qualified to handle it than an attorney who has never handled that type of case. Ask the lawyer to specify the similar cases on his or her list of case results that you have already asked about.

6. Do you have professional liability insurance? Hopefully this would never happen to you, however, if your lawyer makes a mistake on your case, you may have a new legal claim -- against your lawyer. You do not want to hire a lawyer if they do not have professional liability insurance. This insurance would apply if you had a claim against your lawyer. Ask the lawyer you are interviewing to show you a copy of their professional liability insurance. If they hesitate on this request, it probably means they don't have it, and you will want to look elsewhere.

7. Have you ever been disciplined by the State Bar? The Texas State Bar disciplines attorneys if they break the rules. You are entitled to know the disciplinary record of any lawyer you are interviewing. To double check that what they tell you is correct, go to the State Bar of Texas website, and type in the attorney's name in the section at the bottom of the page entitled "Find A Lawyer." In addition to the lawyer's disciplinary history, you will find other basic information on the attorney.
