VB Attorneys Continue With Explosion Lawsuit Against Enterprise Products
Our law firm obtained a Temporary Restraining Order signed by a Harris County District Judge on February 10, 2011. The Judge has scheduled a hearing on this TRO for February 18, 2011 at 1:00 p.m. in the Harris County District courthouse. At this hearing, the Court will consider whether the Temporary Restraining Order should be made a Temporary Injunction. Attorneys for the company are expected to attend this hearing, at which other evidence preservation issues are expected to be discussed.
The TRO prohibits Enterprise Products from getting rid of any evidence that may be relevant to a determination of the cause of the fire, as well as its consequences. For instance, the Order prohibits Enterprise Products from:
-"Damaging, modifying, altering, selling or disposing of in any way the facility or any of its component parts involved in the incident in question";
-"Removing or transporting any of the component parts of the facility involved in the incident from their present location without leave of this Court";
-Destroying or tampering with any of the records or documents or other items relating in any way to the facility or its component parts"
In addition, the TRO states that Enterprise Products may not perform any "destructive testing."
If the company violates any part of this Order, the Court could hold the responsible individuals in contempt of court.
