On May 17, 2010 a huge fire broke out at the LyondellBasell refinery in the southeast Houston / Pasadena area. The company's spokesperson, David Harpole, reported to media outlets that there were no injuries reported in the fire. In the four months since the fire occurred, LyondellBasell has never modified its public statements that there were "no injuries."
As previously reported, VB lawyers represent nine contract workers who were in the vicinity of this fire and who sustained injuries in the chaos at the plant when workers were trying to flee beause they thought the whole thing was about to blow up.
VB attorneys have just obtained documents produced by LyondellBasell in this lawsuit. These are LyondellBasell's own documents concerning its investigation of the fire.
Do the documents confirm the company's prior public statements of "no injuries"? No, they do not.
Here are some of the things that LyondellBasell's own documents say:
- "lost-time injuries"
- "Recordable Injury"
- person "headed to medical"
- "Operator taken to Medical - potential material splash"
- another person "taken to medical - ambulatory"
- another person "taken to Medical - excessive respiration"
- "East Division requesting Medical Assistance - heat exhaustion"
- another person "headed to Medical"
- another person "treated (for heat exhaustion) on site"
- "Medic 1 at north division"
- "patient at Medical for heat exhaustion observation"
- person "ankle swollen - being evaluated"
Many of these documents were created on the date of the fire, as it was happening.
In light of these company documents, it is unclear why LyondellBasell initially reported "no injuries" and why it has never tried to correct its incorrect public statements.
