Houston Unsupervised Trucker Attorney discusses how trucking companies are supposed to supervise their truck drivers.

What are the rules on supervising truck drivers?

Once a trucking company has screened a truck driver and made sure he or she is qualified, the company must supervise the driver. The company must do the following:

* Review the trucker's Driving Record at least once per year (Part 391.25 of the trucking regulations).

* Obtain from the trucker a Record of Violations at least once per year (Part 391.27).

* Conduct periodic Medical & Physical Examinations (Part 391.43).

* Monitor the truckers' Hours of Service (Part 395).

There are other continuing requirements under the trucking regulations, but these are the most important ones.

How do unsupervised truckers cause accidents?

If a trucker is not supervised, the trucking company will not know if the trucker is working safely. What if the trucker causes several accidents? What if the trucker's driving record takes a turn for the worse? What if the trucker contracts a medical or physical condition that prevents him or her from driving safely? What if the trucker ignores the hours of service requirements to make more money behind the wheel?

If the trucking company is not supervising the driver, it will not know about these unsafe items and will not be able to do anything about it -- which will result in a dangerous truck driver on our roadways.
