		<title>Dangerous baby cribs recalled</title>
		<description><![CDATA[The <a href="http://www.cpsc.gov">United States Consumer Product Safety Commission</a> is announcing that Jardine Enterprises, of Taipei, Taiwan, is voluntarily recalling about 320,000 Jardine Cribs.<br><br>According to the CPSC, the crib slats and spindles can break, creating a gap, <span style="font-weight: bold;">which can pose an entrapment and strangulation hazard to infants.</span><br><br>Anyone with one of these cribs should send it back immediately.&nbsp; <br><br>Kudos to the CPSC for pressuring the company to recall these dangerous products.<br><br>To read about other product recalls this week, go to <a href="http://www.cpsc.gov">http://www.cpsc.gov.</a><br>]]></description>

		<title>Are tomatoes a ?dangerous product??</title>
		<description><![CDATA[<p>Houston area grocery stores  have started to cautiously restock tomatoes even as the <a href="http://www.ajc.com/news/content/metro/stories/2008/06/27/tomatoes_salmonella.html">FDA  admits that it isn?t sure what caused the salmonella outbreak</a> that has so  far sickened 810 people in the United    States.&nbsp;  The FDA is concerned that presumably safe tomatoes are being  contaminated in packing sheds or other points along the distribution system,  and that other food items could be the source of contamination.</p>    <p>&nbsp;</p>    <p>Our area has seen its share of salmonella cases.&nbsp; Since May, 15 Houston  residents and 30 other Harris   County residents have  fallen ill with salmonella.&nbsp; Early in  June the first salmonella-linked death happened when a Houston cancer patient was sickened with  salmonella.&nbsp; In all, the <a href="http://www.dshs.state.tx.us/">Texas Department of State Health Services</a>  has reported that so far 342 Texans have become ill.</p>    <p>&nbsp;</p>    <p>The CDC has stated that this is one of the largest  salmonella outbreaks in the country that has been linked to fresh produce.&nbsp; Like the FDA, the <a href="http://online.wsj.com/article/SB121459290782111405.html?mod=googlenews_wsj">CDC  believes that tomatoes are the most likely source</a> but aren?t sold on the  idea that they?re the only possible source.</p>    <p>&nbsp;</p>    <p>If eating a common fruit can cause serious illness, we have  to wonder ? how safe is our food supply, really?&nbsp; It is hard to think that the food we eat  every day could potentially be considered a <a href="http://www.vbattorneys.com/practice_areas/texas-dangerous-produ.cfm">dangerous  product</a>.</p>]]></description>

		<title>6 killed in tragic medical helicopter crash</title>
		<description><![CDATA[<p>A tragedy over the Arizona  skies this past weekend has highlighted the <a href="http://www.vbattorneys.com/practice_areas/texas-helicopter-air.cfm">dangers  of helicopter travel</a>.&nbsp; Six people  were killed and one critically injured <a href="http://afp.google.com/article/ALeqM5h9zCd1ugG8aw0XIHgnoxrJZ97vlQ">when  two medical helicopters collided</a> near a hospital in Flagstaff.</p>    <p>&nbsp;</p>    <p>It?s rare for two medical helicopters to try and land at a  hospital at the same time, as helicopter transports don?t happen that  often.&nbsp; This was certainly a unique  situation, and investigators are sure to ask how it could have been prevented.</p>    <p>&nbsp;</p>    <p>Most hospitals go without <a href="http://en.wikipedia.org/wiki/Air_traffic_controller">flight controllers</a>,  the people who at a normal landing sight ensure that two aircraft don?t collide  on or near the runway while trying to land or take-off.&nbsp; The small volume of flights at most hospitals  equipped with helicopter pads means that it?s up to the helicopter pilots to  judge for themselves if it?s safe to land or take-off.</p>    <p>&nbsp;</p>    <p>It remains to be seen what will be found to be the cause of  this accident.&nbsp; Hopefully some good will  come from this awful tragedy and any similar future collisions avoided.</p>]]></description>

		<title>Union Pacific Railroad settles injury case with railroad conductor</title>
		<description><![CDATA[According to published reports, <a href="http://www.up.com/">Union Pacific Railroad</a> has settled an interesting injury case with a 50-year old railroad conductor.<br><br>The employee was hurt when he slipped and fell on a patch of ice on a motel walkway.&nbsp; He tore his medial and lateral meniscus in his right knee.&nbsp; He suffered from loss of knee cartilage, resulting in bone-on-bone contact, severe arthritis, and will eventually need a total knee replacement.<br><br>According to the railroad conductor, Union Pacific had contracted with the motel to house employees.&nbsp; Thus, the motel was an extension of his workplace.&nbsp; <br><br>Under the <a href="http://en.wikipedia.org/wiki/Federal_Employers_Liability_Act">Federal Employee Liability Act (FELA)</a>, railroads are liable for failing to provide safe workplaces.<br><br>According to the conductor, the hotel was poorly lit, lights were burnt out, and motel management failed to fix the problem even after several people complained.<br><br>The case was tried to a jury.&nbsp; The jury rendered a verdict of $942,000.&nbsp; <br><br>The case is styled Sigler v. Union Pac. R.R. Co., Neb., Douglas Co. Dist., No. 1035-039.<br><br><span style="font-weight: bold;">Important point</span><br><br>Under the FELA (and the <a href="http://en.wikipedia.org/wiki/Merchant_Marine_Act_of_1920">Jones Act</a> since the Jones Act is based on FELA) railroads (and vessel owner/operators) are liable even if the employee is not on their premises if the work is within the course and scope of their employment.<br>]]></description>

		<title>Exxon Valdez case - Punitive damages now allowed under maritime law</title>
		<description><![CDATA[The United States Supreme Court issued its long-awaited decision in the <span style="font-weight: bold;">Exxon Valdez oil spill case.</span><br><br>Once again siding with big business over the rights of individuals and families, the Court sliced down the punitive damage award from $2.5 billion dollars to $500 million dollars.<br><br>Setting aside the fact that $500 million represents <span style="font-weight: bold;">less than one day of profit for Exxon Mobil</span>, and the fact that the Court basically just made up a number out of thin air, and the fact that the punitive damage award, while large, is a drop in the bucket for Exxon, the Court once again <span style="font-weight: bold;">shows a disturbing lack of confidence in the ability of American citizens to serve on juries, listen to evidence, and reach decisions.</span><br><br>Essentially, 8 lawyers from Washington D.C., most of whom have never actually tried a lawsuit themselves, and none of whom has any real idea what the Valdez spill did to thousands of Alaskan families and citizens, have once again s<span style="font-weight: bold;">ubstituted their judgment for the jurors and judges who actually heard the evidence in the case and reached a decision.</span>&nbsp; <br><br><span style="font-weight: bold;">The silver lining</span><br><br>The silver lining in the case is that the justices, perhaps unwittingly, seem to have recognized that punitive damages are recoverable in maritime law.&nbsp; <br><br>For decades, most lawyers who represent Jones Act seaman and injured maritime workers have been under the impression that punitive damages were most likely not available in these types of cases.<br><br>What this has meant, as a practical matter, is that <span style="font-weight: bold;">maritime defendants could treat the injured workers as poorly as they wanted</span>, be as unsafe as they wanted, and avoid any sort of responsibility or threat of punitive damages.<br><br>The Exxon Valdez case seems to take away that defense.&nbsp; Which is very helpful for injured workers, and, suprisingly from this Court, not quite as helpful to big business and insurance companies.<br><br><span style="font-weight: bold;">What do you think about the Exxon Valdez case?&nbsp; Did the Court get it right?&nbsp; Or should the Court defer to the jurors who actually heard the evidence and rendered a verdict?</span><br><br><u><b> Want to know more about maritime injury cases?&nbsp; </b></u><br><br />

		<title>Defective seat belt verdict in Mitsubishi SUV case</title>
		<description><![CDATA[A verdict was reached in favor of a man who suffered fatal head injuries when he was partially ejected through the right rear window of the SUV in which he was a passenger.<br><br>According to reports, the driver lost control of the SUV.&nbsp; The SUV then rolled over.&nbsp; During the rollover sequence, the seat belt failed to restrain the man, and his head was ejected from the vehicle.&nbsp; He suffered fatal injuries as a result.<br><br>His parent and his estate sued the manufacturer of the SUV, alleging that the front passenger seat belt was defective, specifically because it was designed in a way that permitted it to extend too far in an accident.<br><br>The case was styled <span style="font-style: italic;">Laliberte v. Mitsubishi Motors Corp</span>..&nbsp; It was tried in Palm Beach Co. Cir., No. 50 2005 CA 6369 AI, February 26, 2008.<br><br><br><br><br><br><br>]]></description>

		<title>Construction accident in Houston kills 1, injures 7</title>
		<description><![CDATA[The Houston Chronicle is reporting that 1 person was killed and 7 injured when several cinder block walls collapsed at a dormitory under construction at Rice University.<br><br><span style="font-weight: bold;">Too many workers are injured or killed in construction accidents in Texas</span>.&nbsp; The cost of these injuries and deaths, are born by the innocent workers, their widows, and their kids, not by the construction companies, because the Texas Legislature and Texas courts have decided to protect the construction companies instead of the workers and their families who make the construction jobs possible, and have made it very difficult to hold construction companies legally responsible for their negligence.<br><br>To avoid responsibility to construction workers, the construction companies basically create a system or scheme to avoid paying construction workers workers' compensation benefits, health benefits, or benefits of any kind.&nbsp; <br><br>The construction companies also have no incentive to monitor safe conditions at the worksites or ensure that the workers do not get injured.&nbsp; After all, if the construction company have zero legal responsibility for monitoring work safety and practices, most of the time, they just won't do it.<br><br><span style="font-weight: bold;">The result?</span>&nbsp; Way too many construction workers injured or killed, terrible burdens are placed on their wives and kids, and the financial responsiblity is shifted from the construction companies who make profits off taxpayer funded jobs to the taxpayers and widows and kids.<br><br><span style="font-weight: bold;">Do you think this system is fair?&nbsp; If so, why?&nbsp; If not, how would you fix it?&nbsp; </span><br><br>We appreciate any and all comments.<br><br><span style="font-weight: bold;">Want to read more about Texas accident and injury law?</span><br><br><br />

		<title>New Longshore and Harbor Worker's case against Noble Drilling protects injured worker's rights</title>
		<description><![CDATA[The United States Court of Appeals for the Fifth Circuit recently released an opinion that helps to provide legal protection to Longshore and Harbor Worker's who are injured on the job.<br><br>The injured worker, Mark McLaurin, was working in Friede Goldman's shipyard as a scaffold carpenter on the CLYDE BOUDREAUX, a vessel owned by <a href="http://www.noblecorp.com">Noble Drilling</a>.<br><br>Mr. McLaurin was injured during this work.<br><br>Mr. McLaurin sued Noble Drilling, claiming that Noble was negligent.&nbsp; <br><br>The trial court threw out the case, claiming that the Longshore and Harbor Worker's Compensation Act barred state law claims against Noble.<br><br>The Fifth Circuit disagreed, holding the simply because the worker didn't have a 905(b) case against the vessel did not mean the worker was barred from bringing state law claims.<br><br><a href="http://www.ca5.uscourts.gov/opinions/pub/07/07-60402-CV0.wpd.pdf">You can read the full opinion here.</a><br><br><u><b> Want to know more about maritime injury cases?&nbsp; </b></u><br><br />

		<title>Are fire retardants in clothing toxic to our children?</title>
		<description><![CDATA[<p>If you have children, you?ve probably purchased sleepware, a  carseat, or an infant carrier for them.&nbsp; But  did you know that all of these items ? and more ? contain what scientists and  lawmakers now consider a dangerous substance?&nbsp;  </span>What these products have in common is that they?ve all been treated with  a <a href="http://en.wikipedia.org/wiki/Flame_retardant">flame retardant</a>. </p>    <p>&nbsp;</p>    <p>It seemed like a good idea when it was first introduced ?  adding fire protection to items that could be involved in fire-related accidents.&nbsp; For example, manufacturers believed that children  in a car seat could be protected from severe burns if the seats they were in  were treated with a fire retardant chemical.<span style="">&nbsp;  </span>So for decades now, Americans have counted on these chemicals to protect  them from fire</p>    <p>&nbsp;</p>    <p>However now officials are raising serious questions about  the safety of all the products coated with these chemicals.&nbsp; In fact, <a href="http://www.cbsnews.com/stories/2008/05/19/eveningnews/main4109418.shtml">flame  retardants have been banned</a> already in two states have already banned them,  and six other states are considering similar bans.</p>    <p>&nbsp;</p>    <p>Scientists are claiming that the most commonly used brominated  flame retardants, called PBDE's, have a toxic effect on developing brain and  reproductive systems in children.&nbsp; These  chemicals are particularly dangerous because they don?t break down in the body;  instead they persist in our fatty tissue and right now there is no known way to  get rid of them.</p>    <p>&nbsp;</p>    <p>The EPA has joined the fray and is finishing up an  evaluation of the safety of flame retardants.<span style="">&nbsp;  It looks like flame retardants are about to join the long list of dangerous  chemicals that were once championed as safe by manufacturers, but later found  to be toxic to human beings. </p>    <p>&nbsp;</p>]]></description>

		<title>Commercial diver settles injury case against dive company and lift boat company</title>
		<description><![CDATA[We are pleased to announce that one of our clients, a commercial diver<br />
who works offshore, has obtained a settlement against his employer and<br />
a lift boat company following serious injuries he sustained while<br />
diving offshore.<br><br>Our client was employed by <a href="http://www.seamardivers.com/" _fcksavedurl="http://www.seamardivers.com">Seamar Divers</a> and worked on a <a href="http://www.montcooffshore.com/" _fcksavedurl="http://www.montcooffshore.com">Montco Offshore</a><br />
lift boat.&nbsp; According to their websites, Seamar Divers provides<br />
offshore commercial divers, subsea construction, and subsea fabrication<br />
services to the oil and gas industry.&nbsp; Montco Offshore provides lift<br />
boats to the offshore industry.<br><br>Our client was hurt when the Seamar supervisor failed to<br />
monitor the dive properly, resulting in our client getting "the<br />
bends."&nbsp; The Montco crane operator brought him up too quickly and<br />
dropped him too hard on the deck of the lift boat, resulting in severe<br />
orthopedic injuries.<br><br>After working on the case for less than a year, we were able to<br />
negotiate a settlement that takes care of all medical bills, expenses,<br />
attorney fees, and still leaves a substantial monetary recovery for our<br />

		<title>11th largest jury award this year in U-Haul negligence case</title>
		<description><![CDATA[<p>A Dallas  court recently determined that U-Haul was negligent in the case of a 74-year  old man who was severely injured when he was run over by a U-Haul truck with a  defective parking brake.&nbsp; U-Haul?s shoddy  history of vehicle maintenance was brought up in court, and the jury saw fit to  award the victim $84 million, including $63 million in punitive damages.</p>    <p>&nbsp;</p>    <p>U-Haul responded by claiming that the $84 million award was ?particularly  outrageous? and ?another example of abuse of the legal system?.&nbsp; These statements were made despite the fact  that six previous renters had experienced parking brake problems with the same  truck.&nbsp; That?s right, this ?outrageous? verdict  was awarded to a man whose life was ruined when a company rented him a truck  that it knew had problems ? problems that it never bothered to fix.</p>    <p>&nbsp;</p>    <p>Corporations who want to cry foul over large jury awards  need to take a look at their own business practices first.&nbsp; If companies like U-Haul want to time and  again put profits ahead of consumer safety, they are going to be made to pay  the only way our justice system seems to be able to get their attention ? with verdicts  like this.</p>    <p>&nbsp;</p>    <p>What do you think of the $84 award against U-Haul ? is this  an example of abuse in our legal system, or did the company get what they  deserve?&nbsp; Leave us a comment and let us  know.</p>]]></description>

		<title>Texas Supreme Court to review earlier ruling on injured contract workers? ability to sue</title>
		<description><![CDATA[<p>In a move that underscores the influence of large  corporations and powerful insurance companies, the Texas Supreme Court last  year ruled that an Entergy contract worker could not sue Entergy because he  were already covered by a workplace compensation policy.&nbsp; Had this ruling been in place at the time of  the horrific BP plant explosion in 2005, the workers injured and the families  of those killed would not have been able to sue BP.</p>    <p>&nbsp;</p>    <p>Critics claim that this business-friendly ruling ?  unanimously made by an all-Republican Texas  Supreme Court ? gives refineries and other industrial plants a way to sidestep  liability claims from contract workers injured on the job.&nbsp; The rarity with which the Supreme Court  reviews its decisions is proof that the court has heard the criticism of this stunning  ruling loud and clear.</p>    <p>&nbsp;</p>    <p>Not only have families of the BP victims spoken out against  the ruling, but plaintiffs' lawyers, labor unions, lobbyists and even some  legislators ? including one Republican legislator ? rose up to protest what is  being seen as an outrageously biased ruling.&nbsp;  </span>It remains to be seen if the Supreme Court will correct the mistake it  made in last year?s ruling, or if they are merely allowing dissenters to air  their grievances before they simply reaffirm their original ruling.</p>    <p>&nbsp;</p>    <p>Let us know what you think of the Texas Supreme Court?s  ruling that effectively expands refinery and plant owner?s ability to shield  themselves from workplace injury claims.<span style="">&nbsp;  Do you think they?ll reverse their ruling, or ?stay the course??</p>]]></description>

		<title>U.S. Government increases safety investigation of defective Jeep Liberty vehicles</title>

		<title>Back and neck injuries at sea, on vessels, or on offshore oil rigs</title>
		<description><![CDATA[We handle a lot of offshore injury cases.&nbsp; The workers who work on  vessels, be they barges, dredges, boats, cruise ships, oil rigs, crane  barges, or any other type of offshore vessel typically are asked to do  hard, heavy manual work.&nbsp; <br><br>All too often, in our experience, those workers suffer back, neck,  shoulder, knee, or other serious orthopedic injuries as a result of  inadequate equipment, staffing, training, safety precautions, or by  being pushed to do their work too quickly or in unsafe conditions.<br><br>These types of injuries can be career-threatening or even, in some  cases, career-ending.&nbsp; Workers who must have strong backs, legs, and  arms often find themselves unable to do the work when they suffer one  of these types of injuries.<br><br>Often, what will happen after an injury is the company will send the  worker to company-sponsored or company-affiliated doctors.&nbsp; After a  cursory or quick medical examination, the doctor will simply send the  worker back to work on "light duty" or will even give a full release,  without doing a complete or thorough medical examination and before the  worker is ready to return to work.&nbsp; <br><br>When the worker tells the company that he is not ready to return, the  company will give two stark choices--return to work or lose your job.<br><br>Not much of a choice.<br><br>Fortunately, the Jones Act and maritime law provides some legal  protection to workers in this situation.&nbsp; For example, under the Jones  Act&nbsp; and maritime law, you are allowed to go to a doctor of your own  choosing.&nbsp; If you are not physically ready to go back to worker, the  companies should be paying part of your salary in the form of  maintenance payments and should be faciiliating your medical treatment  and paying the doctors promptly.<br><br>If the company (or its insurance companies) don't cooperate and do  everything reasonably in their power to assist you during your  recovery, they may very well be running afoul of the law.<br><br>You can make a legal claim if the companies and their insurance company  do not help facilitate your medical care and act reasonably when you  are injured.&nbsp; In these situations, it is important that you talk with  an experienced Jones Act or maritime injury lawyer, a lawyer you are  comfortable with who has the experience and resources to help you get a  full and fair recovery. <br><br>This is particularly important when your injury is career-threatening or possibly career-ending.<br><br>Don't fall into the "trap" that you must listen only to the company-referred doctor.&nbsp;]]></description>

		<title>Amusement parks aren?t all fun and games</title>
		<description><![CDATA[<p>This past weekend a <a href="http://www.upi.com/NewsTrack/Top_News/2008/03/30/child_knocked_unconscious_by_carnival_ride/7494/">4  year old boy was found unconscious</a> underneath a fire-truck style carnival  ride in Baytown, Texas, prompting state officials to inspect  the accident scene to determine the cause of the accident.&nbsp; The traveling carnival where the accident occurred  will remain closed during this time.</p>    <p>&nbsp;</p>    <p>This child was lucky, as the accident could have been far  more tragic.&nbsp; Amusement parks in the United States  are largely unregulated, and accidents like this ? and worse ? are not  uncommon.&nbsp; The CPSC estimates that in  2006 alone, 17,767 people were <a href="http://www.saferparks.org/database/cpsc_data/cpsc_estimates.php">injured  on amusement park rides</a> ? the highest number of injuries in 9 years.</p>    <p>&nbsp;</p>    <p>Right now efforts to regulate amusement park safety are  hampered because there is no central agency that coordinates ride safety public  policy, and regulation varies from state to state.&nbsp; In addition, there is no coordinated effort  to ensure that problems experienced at one amusement park are prevented from  happening at another.</p>    <p>&nbsp;</p>    <p>Without effective regulations and without federal authority  over amusement park safety, visitors have no idea what to expect when they head  out for a day of fun at one of these parks.&nbsp;  Please see our library article, ?<a href="http://www.vbattorneys.com/library/is-the-allamerican-am.cfm">Is The  All-American Amusement Park Safe?</a>? for more information about this subject.</p>]]></description>

		<title>Can hypothermia make the difference in traumatic brain injuries?</title>
		<description><![CDATA[<p>Using hypothermia to help heal brain injuries is a logical  but unproven idea.&nbsp; The latest patient to  undergo this therapy is <a href="http://www.upi.com/NewsTrack/Entertainment/2008/03/30/navaira_at_center_of_pivotal_medical_trial/9377/">Tejano  music star Emilio Navaira</a>, who is being treated at Memorial Hermann-Texas   Medical Center  because of a tour-bus crash that left him comatose and brain injured.&nbsp; Doctors quickly began hypothermia treatment  in an attempt to reduce injury to his brain.</p>    <p>&nbsp;</p>    <p>The therapy works like this:&nbsp;  </span>a patient's temperature is reduced to about 92 degrees Fahrenheit in an  attempt to give the brain a chance to heal itself.&nbsp; The theory is that hypothermia causes a  decrease in the metabolic rate, allowing the body to get by with less oxygen  and control swelling, which can make a brain injury worse.&nbsp; Hypothermia also slows the production of  chemicals released by the body after a traumatic event, which can also be  harmful to the brain.</p>    <p>&nbsp;</p>    <p>So far the results have not been great.&nbsp; Earlier studies carried in the 1990s found  that patients treated with hypothermia fared no better than those who weren?t.&nbsp; Mr. Navaria is part of a new, better designed  study that is about one-third complete ? a study that researchers expect will  answer the question of whether or not hypothermia treatment is beneficial for  treating brain injuries once and for all.</p>    <p>&nbsp;</p>    <p>It will be a while before the results of this study are in,  but we hope that it proves fruitful.<span style="">&nbsp;  When you consider that about 1.4 million people a year suffer from  traumatic brain injuries and 50,000 die, 235,000 are hospitalized, and 80,000  are left with serious disabilities ? any new treatment would be a blessing for  those suffering the devastating effects of TBI.</p>    <p>&nbsp;</p>    <p>You can read more about <a href="http://www.vbattorneys.com/practice_areas/texas-brain-injury-at.cfm">traumatic  brain injuries</a> in our library articles, ?<a href="http://www.vbattorneys.com/library/making-sense-of-a-tra.cfm">Making  Sense of a Traumatic Brain Injury</a>? and ?<a href="http://www.vbattorneys.com/library/new-dangers-from-brai.cfm">New Dangers  from Brain Injuries</a>?</p>]]></description>

		<title>Preventing slip and fall injuries by using non-skid or non-slip surfaces for walking or working areas</title>
		<description><![CDATA[Any ship, rig, barge, or boat owner who doesn't use non-skid or  non-slip coatings or surfaces whether workers walking (any walking or  working surface) is not living up to his responsibility to protect  workers on the vessel from injury.<br><br>Maritime work can be some of the most rewarding types of employment you  can find, both personally and financially.&nbsp; Maritime work can involve  working on a jack-up oil rig in the Gulf of Mexico, a transport vessel  plying the open oceans,&nbsp; working barges in the intercoastal waterways  or Mississippi River, or anything else involving working on the rivers  or open seas.<br><br>But maritime work can be hazardous if the ship or barge owners do not take proper precautions to protect employee safety.<br><br><b>One of the more common causes of injuries on boats, barges, offshore  oil rigs, and other floating vessels involves slips and falls.&nbsp; </b><br><br>Since maritime work necessarily involves working over, near, in, or  around water, the walking and working surfaces get wet.&nbsp; And that means  slippery conditions.&nbsp; Plus, the stairways and ladders on boats and rigs  are often in tight quarters and very steep, making them even more  potentially dangerous.<br><br>Slips and falls can result in extremely serious injuries.&nbsp; Broken  bones, back and neck injuries, knee, shoulder or elbow injuries, and  even serious head injuries can result from slips and falls.<br><br><u><b>How do you protect yourself?</b></u><br><br>First, always try to be aware of where you are working and walking.&nbsp;  Keep floors and other walking and working surfaces free of debris,  water, grease and other slippery substances.&nbsp; Clean up spills as soon  as they occur.<br><br>More important, perhaps, the captain or vessel owner should ensure that  all walking and working surfaces are coated with some sort of non-slip  or non-skid materials.&nbsp; Anyone who works offshore knows that it is  impossible to keep the surfaces clean of debris or slippery substances  100% of the time.&nbsp; That's why it's so important for the shipowners to  coat the walking surfaces with non-slip materials.<br><br>Any ship or vessel owner who doesn't maintain properly non-slip walking  or working surfaces is not keeping the vessel properly maintained and  could be liable under the Jones Act to any worker who is injured as a  result.<br>  <br>]]></description>

		<title>Widow of deceased barge worker sues barge company under Jones Act</title>
		<description><![CDATA[A barge worker's widow recently filed a lawsuit against a barge company<br />
and a contracting company after her husband was killed.&nbsp; <br><br>In the lawsuit, the widow claims that her deceased husband died when he<br />
slipped and fell on an icy barge.&nbsp; The barge was empty.&nbsp; The lawsuit<br />
claims that the barge company failed to provide the worker with a safe<br />
place to work.<b><u><br><br>About this case and maritime wrongful death claims</u></b><br><br>Under maritime law, the direct descendents of deceased workers may be<br />
able to bring claims for wrongful death.&nbsp; Under most claims, the<br />
survivors must prove that the company did something "negligent" to<br />
cause the death or that the vessel was "unseaworthy" and that caused<br />
the subject accident or death.&nbsp; The damages available differ depending<br />
on a lot of factors, but if the survivors were financially dependent on<br />
the deceased worker, they generally can collect damages for the loss of<br />
financial support.<br><br>The negligence standards differ depending on whether the case is a<br />
Jones Act case, a Longshore and Harbor Worker's Compensation Act case,<br />
a General Maritime Law case, or some other case.<br><br>Most of the time, only an experienced maritime and Jones Act lawyer<br />
will be able to tell you what law you can file under and what claims<br />

		<title>Houston Driver Suffers Brain Injury when Airbag Fails to Deploy</title>
		<description><![CDATA[<p>A Houston man was left with  permanent brain damage when he was involved in an accident with a car on the  610 West Loop, and his driver?s side airbag  failed to deploy.&nbsp; His brain damage was  caused when his head slammed against his car?s steering wheel, which would not  have happened had his airbag functioned as expected.</p>    <p>&nbsp;</p>    <p>There have been dozens of other cases in the Houston area where  airbags have failed to deploy in a crash.&nbsp;  This has prompted lawsuits and investigations into why airbags fail to  deploy in some accidents.</p>    <p>&nbsp;</p>    <p>A review of recall statistics at Safecar.gov reveals that  since airbags were first implemented in passenger vehicles, there have been  over 700 recalls due to airbag or airbag component failures.&nbsp; What is causing all these recalls?</p>    <p>&nbsp;</p>    <p>Manufactures claim that airbags are governed by complicated,  highly scientific sensors that are programmed to determine exactly when an  airbag should and should not deploy.&nbsp;  According to vehicle manufacturers, it may seem as though an airbag  should have deployed, but if the accident was a side-impact crash instead of a  full head-on crash, the airbag would have been prevented from deploying in  order to protect the driver from being injured by the bag.</p>    <p>&nbsp;</p>    <p>Of course this is little consolation to the gentleman who  was left with permanent brain damage after his head-on collision, and countless  others like him.&nbsp; If you suspect that  your airbag should have deployed but did not, the NHTSA wants to hear from  you.&nbsp; You can contact them at 1-888-327-4236  or go to www-odi.nhtsa.dot.gov/ivoq to file a complaint.</p>]]></description>

		<title>Should Exxon be forced to pay $2.5 billion in punitive damages?</title>
		<description><![CDATA[<p>Right now the <a href="http://www.supremecourtus.gov/">Supreme  Court</a> is arguing over whether or not Exxon should be forced to pay $2.5  billion in punitive damages, as approved by a federal appeals court.&nbsp; That?s the largest punitive damages award in  American history, and would be in addition to the $3.4 billion in criminal  fines, cleanup costs and compensation payments they?ve already paid.</p>    <p>&nbsp;</p>    <p>The <a href="http://www.fakr.noaa.gov/oil/default.htm">Exxon  Valdez</a> oil spill in Alaska  covered 3,000 square miles and is still affecting Alaskan fisheries today ? 19  years later.&nbsp; One of the challenges from  Exxon in this case is the finding that Exxon can be held liable for the ship  captain?s actions.&nbsp; According to Exxon?s  lead attorney, this ruiling goes against 200 years of maritime law, where an owner  can be liable only for actions that it directed, ratified or participated in.</p>    <p>&nbsp;</p>    <p>However, Justice <a href="http://www.law.cornell.edu/supct/justices/ginsburg.bio.html">Ruth Bader  Ginsburg</a> disagrees, and has argued that Exxon is partially to blame for the  accident, as company officials allowed the captain to work despite having been  informed that he was an alcoholic and had been drinking.&nbsp; Other justices have sided with Exxon,  including <a href="http://www.law.cornell.edu/supct/justices/kennedy.bio.html">Anthony  M. Kennedy</a>, <a href="http://www.law.cornell.edu/supct/justices/scalia.bio.html">Antonin Scalia</a>,  and Chief <a href="http://www.law.cornell.edu/supct/justices/roberts.bio.html">Justice  John G. 		<title>Bayer's Trasylol linked to 1000 deaths per month</title>
		<description><![CDATA[60 minutes had a chilling expose a few weeks ago on the Bayer drug Trasylol.<br><br>The broadcast told the story of Joseph Radone.&nbsp; Mr. Radone had heart<br />
surgery.&nbsp; The risk asociated with the surgery was around five percent.&nbsp;<br />
Mr. Radone would be home in a week.<br><br>After the surgery, the doctors told the family about "complications"<br />
that had occurred.&nbsp; The doctors told the Joe's wife and daugther that<br />
Traysol was responsible for the complications.<br><br>Only ten days after the surgery, the New England Journal of Medicine<br />
published a study on Trasylol.&nbsp; According to to the study, There was an<br />
"association" between Trasylol and kidney failure and Traysol increased<br />
the risk of death in patients given the drug.<br><br>As far back as the 1980s, German researchers were concerned with the<br />
drug.&nbsp; In 1992, for instance, 13 of 20 patients given Trasylol had<br />
kidney problems afterwards.<br><br>After the New England Journal of Medicine study came out, the FDA held<br />
and advisory meeting to determine the accuracy of the study.&nbsp; At the<br />
hearing, Bayer representatives hid previous studies from the FDA.<br><br>In 2007, a Canadian study was stopped because too many patients in the study were dying.<br><br>After the Canadian study, German authorities banned Trasylol and Bayer temporarily stopped selling the drug.<br><br>After 19 operations including having his eyes sewn shut, removing his<br />
gall bladder, and having his legs amputated, Joe Randone died.<br><br>What do you think about the 60 minutes story?&nbsp; Bayer's conduct?&nbsp;<br />

		<title>BP Texas City Plant Still Nation's Most Dangerous Even After 2005 Explosion That Killed 15</title>
		<description><![CDATA[The Houston Chronicle has an interesting article about British Petroleum and its safety record in today's edition.<br><br>Even after killing 15 people and injuring hundreds in 2005 at its Texas<br />
City refinery, and pleading guilty to a felony as a result of its<br />
conduct leading up to that explosion, BP apparently has not learned its<br />
lesson.<br><br>According to the Houston Chronicle, since the 2005 explosion, BP's Texas City refinery&nbsp; is still the nation's most dangerous.&nbsp; <br><br><a href="http://www.chron.com/disp/story.mpl/metropolitan/5565183.html" _fcksavedurl="http://www.chron.com/disp/story.mpl/metropolitan/5565183.html">You can read the full article by clicking here.</a><br><br>For some reason, the federal government apparently believes that a $50<br />
million dollar fine for BP's felonious conduct would be sufficient<br />
punishment.<br><br>(Tell that to the parents, siblings, and children of the 15 people killed in 2005 and the 4 people killed since then.)<br><br>Many safety focused attorneys have objected to the proposed fine as too lenient.&nbsp; Why?<br><br>Simply put, it is too lenient.&nbsp; A $50 million dollar fine for BP (which<br />
is worth billions) is like a fine of less than one penny for someone<br />
with ten dollars.&nbsp; It's just not high enough to have any deterrent<br />
effect.&nbsp; It doesn't register.<br><br>Rather than have a meaningless, arbitrary fine, that will have a<br />
minimal effect on BP's bottom line, some people have suggested that the<br />
fine should be tied in some way connected to BP's net worth or<br />
profits.&nbsp; That is the only way for the fine to have any "bite" to it.&nbsp;<br />

dangerous or defective products.&nbsp; <br><br>However, the agency typicall delays nearly seven months before telling the public about dangerous products!<br><br><a _fcksavedurl="http://www.citizen.org/publications/release.cfm?ID=7563" href="http://www.citizen.org/publications/release.cfm?ID=7563">You can read the full report and press release by clicking here.</a><br><br>The message for Houston and Texas residents is pretty straightforward.&nbsp;<br />
You cannot rely on the federal or state governments (at least with the<br />
current leaders) to prevent or protect dangerous or defective products<br />
from reaching store shelves.&nbsp; You must protect yourself.&nbsp; Arm yourself<br />
with as much information as possible by obtaining information outside<br />
of the government agencies.&nbsp; <br><br>One of the most productive and helpful function of private product<br />
liability lawsuit is that the manufacturers are often required to<br />
disclose what they knew and when they knew it.&nbsp; And why they continued<br />

		<title>Houston Truck Accident Claims Life of Wife and Mother of Two</title>
		<description><![CDATA[A few days ago, Haydee Valdez Mendez, age 30, died when a large vessel<br />
being transported by an Ace Transportation flatbed truck came off the<br />
flatbed and fell on top of Ms. Mendez's SUV.&nbsp; <br><br>The Houston Chronicle reports that Mrs. Mendez was married with two<br />
young kids.&nbsp; She was studying at the University of Houston-Clear Lake<br />
to be a teacher.<br><br>According the reports in the Houston Chronicle, the driver <i><b>failed to heed posted warning signs</b></i> regarding bridge clearance and failed to follow the designated route allowed by his permit.&nbsp; <br><br>The driver told police investigators that he thought his load was 14 feet 6 inches.<br><br>The vessel was being transported from Capco Fabrications to Henderson.<br><br><a href="http://www.chron.com/disp/story.mpl/nb/pasadena/news/5516868.html" _fcksavedurl="http://www.chron.com/disp/story.mpl/nb/pasadena/news/5516868.html">You can read the entire story by clicking here.</a><br><br>Now that the investigation has begun, one would hope that the company,<br />
Ace Transportation, would do a full-blown investigation into its own<br />
hiring, training, loading, and driving policies, as well as inform all<br />
of its truckers of the importance of following all safety policies and<br />
procedures.&nbsp; We hope the company will not simply rely on the police<br />
investigation.&nbsp; And we hope the company will preserve all the evidence.<span style="text-decoration: underline;"><span style="font-weight: bold;"><br><br></span></span><u><b>Some questions the company should be forced to answer:</b></u><br><br>1.&nbsp; Why was the driver under the impression the load was shorter than it actually was?;<br><br>2.&nbsp; Why was the driver traveling this particular route?<br><br>3.&nbsp; Who trained the driver?<br><br>4.&nbsp; What do Ace Transportation's safety policies and procedures say about this particular operation?<br><br>5.&nbsp; Who loaded the trailer?<br><br>6.&nbsp; Why wasn't the load better secured?'<br><br />

These are just a few of the questions that Ace Transportation should have to answer about this tragic and apparently preventable Houston truck accident.]]></description>

		<description><![CDATA[An article in today?s Dallas Morning News highlights a report by the Consumer Federation of America (CFA) which found that the insurance industry systematically inflates premiums for property and casualty insurance coverage. 		<title>Truck Accident in Pharr, Texas, Kills Four People</title>
		<description><![CDATA[A truck accident early this morning killed four people in Pharr, Texas near the border crossing with Texas and Mexico.<br />

Apparently, a van was hit by two 18-wheelers traveling in opposite directions.  The van's driver was killed.  Three men in a pickup truck took evasive action and plunged over the side, and they were also killed.<br />

		<title>Injured Tankerman Files Lawsuit Against Kirby Inland Marine for Injuries He Suffered at Work</title>

A tankerman employed by Kirby Inland Marine has filed a lawsuit against<br />
the company for personal injury damages.&nbsp; The lawsuit is brought under<br />
the Jones Act and General Maritime Law.<br><br />

According to the lawsuit, the injured employed was badly hurt as a<br />
result of unsafe equipment on a Kirby barge, including unsafe stairs<br />
and poor lighting.<br><br />

The worker claims he qualifies as a Jones Act seaman and is entitled to<br />
maintenance and cure, negligence damages, and damages for the<br />
unseaworthiness of the vessel.<br><br />
