Will I have to go to court to resolve my Texas car crash case?

 

A: You might have to, but more often than not we are able to settle Texas car and truck wreck cases through negotiation, mediation or binding arbitration.  This means you typically get money sooner, because courtroom trials can take a lot of time.

What are these different ways to avoid going to court?  Negotiations are when you, your attorney and the insurance company work out a deal together.  This is probably the easiest way to get your case settled, if you are satisfied with the deal being presented by the insurance company.

If you don’t like what the insurance company is offering and they won’t budge, mediation is an option.  This is when a third party steps in to help each side come to an agreement.  This can be helpful if there are communication problems and each side does not see eye-to-eye.

There is also binding arbitration.  This is a similar process to mediation, where a third party will step in to help the negotiations move along and make a final decision in the case.  However, in binding arbitration the decision of the third party must be accepted by both sides.
