Q: What exactly is a “Jones Act seaman”?

You’ll hear this term a lot when talking about a Jones Act case. In order for you to qualify for the protections afforded by the Jones Act, you first have to determine if you are a Jones Act seamen.
It isn’t as easy as you might think. Sometimes the particular facts in your case, like how and where you were injured and what you were doing at the time can affect whether or not you can be considered a Jones Act seaman.
In general, to be considered a Jones Act seaman you have to be on the crew of a vessel or a fleet of vessels under common ownership (see the FAQ about “vessels” for more on this term). In addition, the work you perform must contribute towards the function or mission of the vessel.
Finally, you have to have a strong connection with the vessel you work on. This means that you have to spend a good amount of time working on the vessel and the type of work you do has to be integral to the vessel’s functioning. Merely being on a boat when you were hurt is not enough to classify you as a Jones Act seaman.
