Should I sign something the adjuster gave me right after my Houston truck crash?
A: Be careful. If you signed a document immediately after a Houston semi accident, you were probably not thinking about the facts on the page—you were tired, scared, and wanting to go home. Unfortunately, quickly signing a settlement with an adjustor can jeopardize your ability to receive adequate compensation for your injuries and property damage.
Insurance adjusters and representatives of the trucking company will often try to get you to sign forms as soon as possible, knowing that you are confused and shaken in the days after the crash. The full extent of your injuries is still unknown, and they may try to convince you that you will get more money—and get it faster—if you make a deal with them. This is just a trick though; they are rushing you into signing because they want you to settle for less than your case is worth.
Here are two types of insurance adjusters who may contact you in the days after a crash:
The truck company’s insurers. The trucking company’s rep may act sympathetic, but he is only protecting his employer’s interests. Adjusters will often use a compassionate ear to try to make you say something that can be used against you. For instance, the adjuster may attempt to lure you into stating that you were partially at fault, which may prevent the insurance company from having to pay you anything.
Your car insurance company. Beware any adjuster who offers you a settlement quickly. It may mean that they think they are liable for much more, and are they offering you a chance to take a lower settlement before you realize how much your case is worth.
