Q: Should I negotiate my case directly with the insurance company?
A: The short answer to this question is almost always "no." In most cases in the current legal environment, insurance companies use the pre-suit negotiate to find out as much about you as they can, before you have a lawyer. The insurance companies ask for recorded statements from you before you get legal advice. They ask you to sign all sorts of forms. They ask for detailed information about your medical and claims history. And then, once they've got you pinned down, they try to settle your case cheaply. Every once in a while, a pre-suit, pre-lawyer negotiation will make sense. But those situations are the exception and not the rule. At our firm, we usually file your case immediately. That way, we know that if the insurance company refuses to pay a fair settlement, we have a court date and will be prepared to try your case to a jury and let them decide. In our experience, insurance companies only pay fair settlements when they are are about to be called to trial. The other reason filing suit quickly is a good idea is because in most cases, if you don't file within a certain time period, your claims will be forever barred by a "statute of limitations." The insurance companies will often string you along until the statute of limitations has expired, then offer nothing. At that point, there's almost nothing you can do. The insurance companies have teams of lawyers and adjusters. You should too. Don't be fooled by empty promises of fair treatment. It almost never happens.
