Can I sue the driver of the car that I was in when I was badly hurt in a crash?

A:

If the driver of the car that you were riding in at the time of the accident is at fault for causing an accident that resulted in injury to you, then you deserve compensation.  For example, if the driver was driving while intoxicated and there is a police report to go along with the accident documenting that the driver was intoxicated then you would have a good case.

When you are a passenger in a vehicle, the driver has a duty to drive in a reasonably safe and responsible manner.  If they drive carelessly, or if they are reckless (speeding, weaving in and out of lanes, tailgating) and these actions contribute to a crash, they could be found to be negligent for causing the accident.

If you are seriously hurt because the driver of the car you were in was being careless, it may be worth your time to talk with an attorney about your case.  If the other driver was in fact being negligent, then you could be entitled to receive compensation for your injuries and suffering.
