A: Yes. Just because the accident happened after Toyota announced the recall does not mean there is no case.
By recalling vehicles for the Floor Mat Entrapment and Pedal hazards, Toyota has essentially admitted there are problems with those vehicles. This will strengthen lawsuits in which these hazards caused an accident and injuries.
You may be concerned that Toyota can argue that you knew about the recall, and therefore should not have been driving the Toyota vehicle and therefore the accident is your fault. If Toyota asserted this argument in a lawsuit, it would be a very weak one. Even now, Toyota is not telling people to stop driving it's recalled vehicles.
Whether an accident involving a Toyota Recalled Vehicle happens before or after the recall should not have any significant impact on a Toyota Recall Lawsuit.
