A Houston resident bought a life insurance policy on her dad through Lincoln National Life Insurance Company. Less than two years after the policy was purchased, her dad passed away due to lung cancer.
Lincoln National denied the claim, stating that the family made "material misrepresentations" in the application. Namely, the family did not disclose a history of lung cancer, stroke and dementia. Lincoln National indicated that if it knew about this medical history, it would not have issued the policy.
The family hired the Texas Insurance Claim Lawyers at Vujasinovic & Beckcom to assist her. After continued demands issued to Lincoln National, the insurance company continued to refuse to pay anything at all on the claim.
V&B attorneys filed a lawsuit in Harris County state court. The insurance company removed the case to federal court. Discovery was conducted in federal court.
The case was mediated. V&B lawyers negotiated a settlement under which Lincoln National paid $231,500, which was almost three quarters the face amount of the policy. Attorney's fees are $92,600, and litigation expenses are $9,000.
