Maribel was driving her Nissan Altima southbound in the right hand lane of S. Main in Pearland, Texas, when she struck the rear of a flatbad trailer being towed by SWJ Transportation. The truck driver had parked the 18 wheeler in the right hand lane of the roadway and entered a store. Maribel suffered very severe orthopedic injuries to her face, hips and legs.
The 18 wheeler had insurance in the amount of $1,000,005. The insurance company denied Maribel's claim, offering her nothing. Maribel hired Vujasinovic & Beckcom to pursue her claim for her.
V&B filed the case in Brazoria County, Texas. Through document discovery and deposition testimony, V&B established that the SWJ Transportation driver parked the 18 wheeler illegally, violated the Texas Motor Carrier Safety Regulations in failing to place warning devices behind the 18 wheeler, and violated the trucking regulations in having improper warning flags attached to the flatbed trailer.
V&B was successful in recovering the maximum insurance amount of $1,000,005 on Maribel's case. Attorney fees were $350,000, and litigation expenses were $42,000.
Awarded: $1,000,005 settlement; $350,000 attorney fee; $42,000 expenses
