Day laborer who suffered brain injury when struck in head by log obtains settlement

Johnny was working as an independent contractor day laborer for Ramrod Enterprises.  Johnny was working at the company's timber facility in Conroe, Texas, when an employee of the company operating a backhoe with a large log attached to it caused the log to hit Johnny in the head.  Johnny sustained a brain injury.

Ramrod Enterprises had liability insurance with Hanover Insurance Company.

The company lawyers argued that Johnny was a "borrowed servant" of Ramrod Enterprises.  If this was true, then Johnny's case against the company would be barred by the Texas Workers Compensation Act because the company had workers compensation insurance and Johnny would be considered to be an employee of the company.  Employees of employers who have workers compensation insurance cannot sue their employers. 

V&B attorneys defeated this defense.  V&B lawyers obtained the file from the company's workers compensation insurance company, which showed that this insurance company did not pay any workers compensation benefits, which in turn contradicted the company's defense. 

The company lawyers also argued that Johnny was to blame for his accident, but V&B attorneys disproved this defense.
