Gerardo was employed as an 18 wheeler driver by
Gulf Winds International, Inc. Gerardo was driving on Barbours Cut Blvd. in La Porte, Texas when an 18 wheeler driven by Jose Aparicio, an employee of
Canal Cartage Company, cut him off, causing a crash. The investigating police officer placed 100% of the fault on the Canal Cartage driver.
Canal Cartage had an automobile insurance policy. Despite the investigating officer's findings, the insurance company denied Gerardo's claim.
Gerardo's doctors said he needed a spine fusion surgery, which he had some time after the 18 wheeler wreck.
The insurance company continued to deny Gerardo's claim. Gerardo hired
Vujasinovic & Beckcom to represent him in his 18 wheeler accident and injury case. V&B lawyers filed Gerardo's 18 wheeler accident case in Harris County, Texas.
Canal Cartage Company's insurance carrier hired lawyers to represent the company. The lawyers continue to deny responsibility on behalf of the company.
Thus far in discovery, V&B attorneys have uncovered evidence that this Canal Cartage driver was involved in at least five prior 18 wheeler accidents on the job with this same company. V&B lawyers further uncovered evidence that this driver, and Canal Cartage Company, violated many of the
Federal trucking regulations, including the destruction of important trucking documents. V&B lawyers further discovered that Canal Cartage fired its driver, Mr. Aparicio, after this crash.
It is unclear why Canal Cartage Company, which does business throughout the United States, continued to allow Mr. Aparicio to drive its 18 wheelers, considering his prior accident record.
