A mourning couple has filed a
Texas wrongful death lawsuit against a grill manufacturer that they say is directly responsible for the death of their 12-year-old son.
Two years ago, Daniel and Heather Hamm were having a backyard barbeque with their son, Joshua. The young man had just flipped over the hamburgers and closed the lid of the grill when the lower charcoal door came open, shooting flames in the direction of Joshua. He inhaled the flames and was severely burned by the possibly defective product, a Model 92930 30-inch Deluxe Charcoal Grill manufactured by Royal Oak Enterprises and sold by Wal-Mart.
The boy was rushed to the Children’s Hospital in Dallas, but went into cardiac arrest in the ambulance. He died from his
burn injuries the next day. According to the Texarkana court documents, the family is suing for wrongful death, medical expenses, funeral expenses, pain and suffering, mental anguish, grief and sorrow, loss of love and affection, loss of emotional support, and court costs. The couple believes that the grill maker was grossly negligent in selling a grill with an improperly closing charcoal door and in not warning grill users of the dangers and risks of their product.
